Please read these Terms and Conditions (“Terms”, “Terms & Conditions”) carefully before using the https://www.riannahijlkema.com/ website operated by Chasing Excellence, LLC (“us”, “we”, or “our” “organisers”).
By registering for the (virtual) retreat, participants agree to these terms and conditions.
Participation and Eligibility:
a. Participation in the (virtual) retreat is open to women (and their partners) who are involuntarily childless.
b. Participants must be at least 18 years old at the time of registration.
c. Participants are required to fill out a registration form and provide accurate information.
d. The organisers reserve the right to accept or reject any application for participation.
Payment and Cancellation:
a. Participants are responsible to read and understand the cancellation policy before registering.
b. Participants acknowledge that there will be no refunds or discounts for arriving late, leaving early, flight cancellations, travel delays, illness, or technical problems. Participants are strongly encouraged to purchase travel insurance.
c. Cancellation by a participant 14 days prior to the virtual retreat start date will be refunded minus a 10% cancellation fee. Cancellation 1-13 days prior to the virtual retreat start date will not be refunded.
d. Cancellation by a participant 120 days prior to the in-person retreat start date will be refunded minus a non-refundable deposit. Only if the organisers are able to reassign your seat to another participant will you be eligible to receive a refund:
– 90-119 days prior to the in-person retreat start date, you will receive a 65% refund minus deposit.
– 60-89 days prior to the in-person retreat start date, you will receive a 50% refund minus deposit.
– 30-59 days prior to the in-person retreat start date, you will receive a 25% refund minus deposit.
– 0-29 days prior to the in-person retreat start date, there will be no refunds.
e. Cancellation by a participant after the retreat start date will not be refunded.
f. The organisers reserve the right to cancel or reschedule the (virtual) retreat due to unforeseen circumstances. These events may include, but are not limited to natural disasters, pandemics, wars, acts of terrorism, strikes, government regulations, and other similar events beyond the control of the organisers. In such cases, participants will be offered the option to reschedule or receive a full refund.
Code of Conduct:
a. Participants are expected to conduct themselves in a professional and respectful manner at all times.
b. Discrimination, harassment, or any form of inappropriate behaviour will not be tolerated.
c. The organisers reserve the right to remove any participant from the (virtual) retreat who violates the code of conduct.
Content and Materials:
a. All (virtual) retreat content and materials provided to participants are the property of the organisers and may not be used, copied, reproduced or shared without prior written permission.
b. Participants are advised to read the terms and conditions and privacy policies of any third-party websites or services that will be used as part of the (virtual) retreat.
c. The organisers reserve the right to make changes, updates, and corrections to any information, errors, inaccuracies, or omissions without prior notice.
d. The organisers may take photographs or record videos during the (virtual) retreat for marketing purposes. Participants who do not wish to be photographed or recorded may inform the organisers in writing prior to the (virtual) retreat start date.
e. Participants are responsible for their own internet connection and technical equipment necessary to participate in the (virtual) retreat.
f. The organisers are not responsible for any technical difficulties experienced by participants.
Travel & Health Requirements
a. Participants are responsible for ensuring they have the appropriate documentation and immunisation and meet any health requirements necessary to participate in the (virtual) retreat required by the country where the (virtual) retreat is taking place.
b. Participants are required to consult a physician before participating in the (virtual) retreat to ensure they are physically eligible to engage in strenuous activities, and participants waive and release any claim that they may have at any time for injury or any sort agains the organisers or any person or entity in any way involved therewith.
c. Participants agree to keep the organisers informed of any changes to their physical health and personal information and warrant that all information provided to the organisers is accurate and up-to-date.
d. Partipants is responsible for their own travel costs to and from the (virtual) retreat. If meals are included, participants must inform the organisers of any dietary restrictions at least six (6) weeks prior to the (start) date of the (virtual) retreat. The organisers and any chefs or caterers participating in the (virtual) retreat shall not be held liable for any illness or allergic reaction to any food items provided during the (virtual) retreat
e. Participants acknowledge that organisers may provide medical assistance, transportation, and emergency services if necessary, but participant alone is responsible for any medical costs incurred.
Liability and Indemnity:
a. The organisers are not responsible for any personal property, any lost, damaged or stolen item, or personal injury/death while traveling to and from or while on the (virtual) retreat.
b. Participants are responsible for their own physical and emotional well-being during the (virtual) retreat.
c. Participants are strongly advised to have their own (health/travel) insurance coverage for any potential risks or incidents that may occur during the (virtual) retreat.
d. Participants agree to indemnify and hold the organizers harmless from any claims, damages, or expenses arising from their participation in the (virtual) retreat, including but not limited to the content, terms and conditions, privacy policies, or practices of any third party.
Assumptions of the Risk:
By participating in the (virtual) retreat, participants acknowledge and agree to assume the risks and responsibilities associated with such participation, which may include but not limited to:
- Exposure to a variety of liabilities and risks inherent in outdoor activities and (virtual) retreats.
- Additional inherent risks presented by the international location of the (virtual) retreat, including political, health, cultural, and geographical attributes.
- Negative treatment by foreign third parties unaffiliated with the organisers.
- Dangers of serious personal injury, death, and property damage resulting from physical exercise and exertion, physical contact with other participants or third parties, falling or tripping due to environmental hazards, uneven surfaces, or debris, other health hazards associated with physical activity and outdoor events, injury or death resulting from exposure to unfavorable weather conditions, and hazards related to catering, including but not limited to food sickness, allergic reactions, choking.
- Injuries and Damages that cannot be entirely eliminated.
- Injuries and Damages that may occur by natural causes or activities of other persons, environmental circumstances, the organisers, or other third parties, either as a result of negligence or because of other reasons.
- The fact that third parties cannot necessarily be controlled, and that Participant’s safety, physical health, or emotional wellbeing cannot be guaranteed while participating in the (virtual) retreat and related activities.
Responsibility and Release:
By agreeing to these terms and conditions, you fully understand and accept that you are solely responsible for any and all risks associated with participating in the (virtual) retreat and related activities, and you release the organisers and its affiliates, directors, officers, employees, agents, and representatives from any and all claims, demands, damages, costs, expenses, and liability arising out of or related to your participation in the (virtual) retreat and related activities, to the fullest extent permitted by law. If any provision is deemed unlawful, void, or unenforceable, the rest of the Terms will remain valid. This agreement shall be governed by and construed in accordance with the laws of the State of Wyoming.
We reserve the right to modify or replace these Terms at our discretion. Participants of upcoming (virtual) retreats will be notified of any changes 30 days in advance. Your continued participation after the effective date of revisions indicates acceptance of the revised terms.
